The City took the matter to appeal but lost the matter late
on Wednesday.

The CTMCA described the verdict as ‘’a historic victory’’

‘’After nine years of unwavering dedication, the court has
ruled in favour of Mr. Richard Stemmet and the CTMCA, after the City filed for
an appeal for the court judgment 29 December 2025 and yet again, today at 00:30
ruled against the City and ordered the City again to uphold the constitutional duty
to support and prioritise community interests,’’ read the statement.

‘’This triumph is a testament to the power of community and
the importance of preserving cultural heritage. We than out supporters,
spectators, and the people of Cape Town for standing with us in this fight for
what is rightfully ours,’’ it added.
